The information age’s miraculous ability to share ideas, sounds, and images with anyone, anywhere, is made possible by an open and interconnected architecture of cables, servers, relays and switches that span the entire globe. But the ability to exchange information globally rests also on another network of interconnected national rules, regulations, and treaties that reconcile the differences between different legal jurisdictions and traditions and make it possible to safely transfer information across national borders.

One of the main pieces of this “internet of laws” was the EU-U.S. Safe Harbor Framework, which for fifteen years made it easy for individuals and companies in the EU to lawfully transfer personal data to the U.S.

When, in October 2015, the Court of Justice of the European Union handed down the Schrems decision invalidating the EU-U.S. Safe Harbor framework, a big part of the data transfers between the EU countries and the U.S. came under a cloud of legal uncertainly.

Thankfully that period of uncertainty is now over. In July 2016, the European Commission approved the Privacy Shield Framework, which was designed by the European Commission and U.S. Department of Commerce to provide a robust mechanism for companies on both sides of the Atlantic to lawfully transfer personal data from the EU to the U.S.

Kaltura was among the very first companies to self-certify under the Privacy Shield Framework when it opened in August 2016.

Kaltura has stated in our privacy notice our commitment to data protection principles that comply with EU data protection requirements. Our commitment is legally binding and enforceable by the Federal Trade Commission. And under certain conditions, individuals in the European Union can submit complaints for conflict resolution by the American Arbitration Association at no cost and have recourse to binding arbitration to address complaints that have not been resolved.
